Basis of General Agreement

 

Scope of Agreement – These Terms and Conditions govern the use of any Services related to this website or affiliated websites of Organization or its institutions (subdivisions), and the resulting agreement between you and Organization from such use, defining the rights and obligations of all users of the Services under applicable law.

 

The Organization – This Policy applies to Ignita Veritas United (International), and its management company of domestic representation Ignita Veritas United (United States), which is registered as a non-profit incorporated in the State of Delaware, jointly and severally, as “Organization”, collectively represented by its official website <ignitaveritasunited.org>.

 

Services Defined – The “Services” means any and all online content or functions provided by this website or affiliated websites of Organization or its institutions (subdivisions), including any related membership platform, community interaction, group collaboration, project management, institutional access, educational or library applications or systems provided to visitors or users.

 

Agreement by Use – These Terms and Conditions apply to any Services which you choose to participate in through this or affiliated websites, and apply to all visitors, users and others who access or use the Services.  By accessing or using such Services, you agree to be bound by these Terms and Conditions, as a condition of such access or use.

Operational Provisions for Services

 

Age Requitement – By using the Services you represent that you are age 17 years or over.  Organization does not permit those under 17 years of age to use the Services, without verification of parental consent.

 

Links to Websites – Our online Services may contain links to third-party websites or services which are not owned nor controlled by Organization.  Organization has no responsibility for the content, privacy policies, or practices of any third-party websites or services, and shall not be liable directly or indirectly for any damage or loss alleged or caused in connection with the use or reliance on any such content or services.

Termination – Organization may suspend or terminate your access to the Services immediately, without prior notice, without liability, for any reason whatsoever, including if you breach these Terms and Conditions.

 

Warranty Disclaimer – The Services are provided “As Is” and “As Available”, with any and all faults and defects, without any warranty.  Organization, on behalf of itself and any of its service providers, expressly disclaims all warranties relating to the Services, whether statutory, express or implied, including any warranties of compatibility, performance, reliability, availability, accuracy, or fitness for a particular purpose.

 

Limitation of Liability for Services

 

Limitations – Under these Terms and Conditions, the entire liability of Organization and any of its contracting partners, and your exclusive remedy regardless of any damages which you may incur, shall be limited to the amount actually paid by you through the Services, or if nothing was paid then the amount of $100 USD.

 

Exclusions – Organization shall not be liable for any special, incidental, indirect or consequential damages whatsoever, arising out of or in any way relating to the use of or inability to use the Services, regardless of whether Organization or any contracting partner has been notified of the possibility of such damages.

 

Jurisdictions Relevant to Services

 

Domestic Jurisdiction – The application of domestic jurisdiction to the Services shall be limited to the related functions of payment processing and banking operations, for financial regulatory compliance purposes.  All financial transactions are conducted by the namesake management company as the registered domestic representation of Organization, duly incorporated in Delaware.  Therefore, the laws of the United States and the State of Delaware govern all banking compliance matters.

 

Foreign Jurisdiction – All use of the Services and resulting activities or relations are conducted in the sovereign jurisdiction of Organization as an intergovernmental organization (IGO), under its constitutional Charter published on its official website as public notice, in the independent and universal jurisdiction of international law.

 

Accordingly, Organization shall not be considered to be operating in the domestic jurisdiction of the country of the user by reason of use of the Services.  Rather, the user through such use shall be deemed to voluntarily reach out, enter into and act within the foreign jurisdiction of Organization under international law.

 

User Jurisdiction – In addition to the above jurisdictions, your use of the Services may also be subject to the local, state or national laws and jurisdiction of the country of your citizenship or residence or operations.

 

Dispute Resolution Provisions

 

Informal Cooperation – If you have any concern or dispute relating to the Services, you agree to first make good faith efforts to resolve any dispute informally by contacting Organization, through the Contact page on our website, to request assistance.

 

Binding Arbitration – The parties hereby expressly agree that any and all disputes arising in connection with the Services shall be exclusively submitted to and fully resolved solely by mandatory Binding Arbitration, adjudicated by the Arbitration Court of International Justice (ACIJ), an autonomous agency operated by the independent Judiciary Profession, in accordance with its arbitral rules and procedures.  Process shall be conducted by correspondence for the convenience and economy of the parties.

 

Other Legal Provisions

 

Translations – These Terms and Conditions may have been automatically translated through available language translation functions of our website or a user Internet browser.  In all cases, only the original English text shall be used to legally determine correct interpretation of its provisions in the event of any dispute.

 

Changes – Organization reserves the right, at our sole discretion, to modify or replace these Terms and Conditions at any time.  Publication of any updated text containing changes, on the official website of Organization, with an indication of the date of the current or updated version, shall constitute sufficient and effective public notice to all current and potential users of the Services.

 

Severability – If any provision of these Terms and Conditions is held by a judiciary authority to be unenforceable or invalid, such provision shall be interpreted to accomplish its apparent purpose and intent to the greatest extent possible under applicable law, and all remaining provisions shall retain their full force and effect.

 

Waiver – Except as may be provided herein, any failure to assert or exercise a right, or to request or require performance of an obligation under these Terms and Conditions, shall not affect a party’s ability to assert such right or obligation at any time thereafter, and any waiver of a breach shall not constitute a waiver of any subsequent breach.
